What you agree to when you use Kithr.

1. About these terms
These Terms & Conditions govern your use of the Kithr app and the Kithr website at kithr.app.
Kithr is operated by Matthew Adams, a sole trader based in Scotland, United Kingdom, trading as Kithr (“Kithr”, “we”, “us” or “our”).
By downloading, accessing or using Kithr, you agree to these terms. If you do not agree to them, please do not use Kithr.
Kithr is intended for people aged 18 and over.
2. App Store terms
Kithr is distributed through Apple's App Store. Your licence to download and use the Kithr app is also subject to Apple's applicable App Store terms, including Apple's standard end-user licence terms where they apply.
If there is a conflict between these Terms & Conditions and mandatory terms that apply to your use of Kithr through Apple's App Store, those mandatory terms will apply to the extent of the conflict.
3. What Kithr provides
Kithr is a personal relationship and memory tool. It helps you keep information about people in your life, including details, memories, relationships, groups, birthdays, locations and other information you choose to record.
You may use Kithr for personal purposes and for managing professional relationships, such as remembering information about colleagues or professional contacts.
Kithr is a tool to help you remember and organise information. It is not intended to provide medical, legal, financial or other professional advice.
4. Purchase and payment
Kithr is offered as a one-time paid App Store purchase. At launch, Kithr does not require a subscription, contain paid in-app purchases, include advertising or offer a free trial.
Your purchase is processed by Apple. Kithr does not directly receive or process your payment card information.
Requests for refunds for App Store purchases are handled by Apple in accordance with Apple's policies and your applicable consumer rights.
A one-time purchase does not amount to a promise that Kithr will receive updates forever, remain compatible with every future version of Apple's operating systems, or that every future product or feature we may create will be provided without additional charge.
Nothing in this section affects rights you have under applicable consumer law.
5. Your licence to use Kithr
Subject to these terms and the applicable App Store terms, you may use Kithr on Apple devices that you own or control as permitted by Apple's usage rules.
Kithr may also be used through Apple's Family Sharing where Apple makes Family Sharing available for Kithr and your purchase is eligible.
Your licence is for using Kithr as intended. You may not sell, sublicense, redistribute or commercially exploit the Kithr software itself except where applicable law expressly permits you to do so.
6. Device requirements
Kithr requires compatible Apple hardware and supported versions of iOS, iPadOS or macOS.
Minimum hardware and software requirements may change over time as Apple's platforms evolve. Some Kithr features may require particular hardware or operating-system capabilities.
For example, features that use Apple Intelligence may only be available on devices and operating-system versions that support the relevant Apple technologies.
7. Your information and content
You retain whatever rights you have in the information, photos, memories, notes and other content you add to Kithr. Using Kithr does not transfer ownership of that content to us.
Kithr is designed so that we do not receive or host your private Kithr database. We therefore do not require a broad licence to use the people, memories or other private information you store in the app.
You are responsible for the information you choose to record and for ensuring that your use of it is lawful and respects the rights and privacy of other people.
Please take particular care before recording sensitive or private information about another person.

8. Acceptable use
You must use Kithr lawfully and responsibly.
You must not use Kithr to:
- break the law or infringe another person's rights;
- harass, stalk, threaten or abuse another person;
- knowingly store or use information obtained unlawfully;
- interfere with, damage or attempt to compromise Kithr, Apple's services or related systems;
- attempt to gain unauthorised access to information or systems; or
- reverse engineer, copy or redistribute Kithr except where applicable law expressly permits it.
9. Your data, backups and exports
Kithr is designed to store your information locally and can use Apple's iCloud services to synchronise Kithr data across your devices.
We take reasonable care in developing Kithr, but no software, device or storage system can guarantee against every form of data loss.
Data loss can result from circumstances including device failure, software defects, accidental deletion, operating system changes or problems affecting third-party services such as iCloud.
You should maintain appropriate backups of information that you cannot afford to lose.
Kithr provides an Export My Data feature that lets you create a local archive of your meaningful Kithr data and stored images. We recommend using this feature where you want to maintain an independent copy of your Kithr information.
Nothing in this section excludes or restricts any rights or remedies you have under applicable consumer law.
10. Deleting your data
You can delete individual information from Kithr and can use Delete All Data in Settings to remove your Kithr content.
Delete All Data is a destructive action. Once confirmed, Kithr will remove your Kithr content and, where applicable, request deletion of corresponding Kithr data synchronised through iCloud.
You should export anything you wish to keep before using Delete All Data.

11. Kithr AI
On supported devices, Kithr may use Apple's on-device intelligence to generate summaries from information you have stored in the app.
AI-generated content can sometimes be incomplete, inaccurate or omit relevant context. Kithr AI summaries are provided as a convenience and should not be treated as an authoritative record of a person, conversation or event.
You should check important information rather than relying solely on an AI-generated summary.
12. Apple and third-party services
Kithr integrates with services and technologies provided by Apple, which may include the App Store, iCloud and CloudKit, Contacts, Maps, Apple Intelligence, Siri, Spotlight, Shortcuts and system sharing features.
Your use of Apple services is also subject to Apple's applicable terms and policies.
Apple controls the operation and availability of its own services. We are not responsible for outages, changes, restrictions or failures of third-party services that are outside our reasonable control.
Nothing in this section limits responsibility that cannot legally be excluded or affects your mandatory consumer rights.
13. Updates and availability
We may update Kithr to add or remove features, fix problems, improve performance, maintain security or adapt to changes in Apple's platforms and technologies.
We do not promise that Kithr will always be uninterrupted, error-free or compatible with every future Apple device or operating-system version.
We may eventually discontinue Kithr or particular features. Where reasonably practical, we will try to avoid unnecessarily preventing existing users from accessing their locally stored information and will provide appropriate notice of material changes where possible.
14. Beta and TestFlight versions
We may make pre-release versions of Kithr available through TestFlight or another testing programme.
Pre-release software is provided for testing and may contain more defects than a public release. Features, behaviour and data formats may change before the final version is released.
You should not rely on a beta version as the only copy of important information.
15. Feedback
If you voluntarily send us product suggestions, feature ideas, bug reports or other feedback about Kithr, you agree that we may use that feedback to develop and improve Kithr without payment or obligation to you.
This does not give us rights over the private information, memories, photos or other content you store inside Kithr.
16. Intellectual property
Kithr, including its software, design, branding, name, website and original content, is owned by Matthew Adams trading as Kithr or by the relevant licensors.
These terms give you permission to use Kithr as described here. They do not transfer ownership of Kithr, its software or its intellectual property to you.
If a third party claims that Kithr itself infringes their intellectual property rights, responsibility for addressing that claim rests with Kithr rather than Apple, to the extent required by the applicable App Store terms and law.
17. The Kithr website
The Kithr website is provided to give you information about Kithr and related products or services.
You may view and use the website for its intended purpose. You must not misuse it, interfere with its operation or copy and redistribute protected Kithr content except where permitted by law.
We may update, change or temporarily remove website content without notice.
18. Your consumer rights
Nothing in these terms excludes, restricts or replaces rights that you have under applicable consumer law.
If you are a consumer in the United Kingdom, digital content supplied to you is subject to statutory protections, including requirements relating to satisfactory quality, fitness for purpose and conformity with its description.
Consumers in other countries or regions may have equivalent or additional mandatory rights under their local laws.
19. Reasonable limitations
We will provide Kithr with reasonable care and skill. We cannot promise that every feature will always be available, that Kithr will be entirely free from defects, or that it will meet every individual requirement.
To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when you began using Kithr, or for losses caused by circumstances outside our reasonable control.
If you use Kithr for business or professional relationship management, Kithr remains primarily a personal organisation tool and is not provided as a specialist business records, compliance or customer-management system.
Nothing in these terms limits or excludes liability where doing so would be unlawful, including liability for fraud or fraudulent misrepresentation, or for death or personal injury caused by negligence.
20. Ending your use of Kithr
You may stop using Kithr at any time and remove the app from your devices.
Before deleting Kithr or its data, you should export any information you want to keep.
Because Kithr does not operate user accounts, there is no separate Kithr account that needs to be closed.
21. Governing law
These terms are governed by the laws of Scotland.
If you are a consumer, this does not deprive you of mandatory protections given to you by the law of the country or region where you live, or of any mandatory right you have to bring proceedings in another court.
Subject to those mandatory rights, disputes relating to these terms or Kithr may be dealt with by the Scottish courts.
22. Changes to these terms
We may update these terms as Kithr develops, our commercial model changes or legal requirements change.
If we make material changes, we will provide additional notice where reasonably appropriate. The effective date at the top of this page shows when the current version took effect.
Changes to these terms do not retrospectively remove rights that you have already acquired under applicable law.
